After the 7 day cancellation period, under the Consumer Code for New Homes a Buyer is not entitled to a refund of a reservation fee if they can’t proceed with the purchase, or if they change their mind for whatever reason.
Your client should contact the Structural Warranty provider if they think the complaint relates to those areas covered by the Structural Warranty.
For complaints about areas covered by the Code, your client can escalate their complaint to a formal dispute and apply to our independent Dispute Resolution Scheme run by CEDR. The application forms for this process are available here.
Your client can escalate their complaint if:
1. The developer has not responded to their formal complaint made in writing within 30 working days
2. Your client and the developer have reached a point where they can’t agree on resolution of the complaint
3. 56 calendar days have elapsed since your client made their complaint to the developer, and they choose to pursue their complaint formally via the independent Dispute Resolution Scheme
